Pravni aspekti građanskih i verskih sloboda jevrejske zajednice na našim prostorima

Abstract

U radu se analiziraju pravni aspekti građanskih i verskih sloboda pripadnika jevrejske zajednice kroz analizu ustavnih odredbi, zakona i podzakonskih akata kojima su regulisani odnosi na našim prostorima. Predmet analize je položaj jevrejske zajednice u Kneževini i kasnije Kraljevini Srbiji, kao i u Kraljevini SHS i Kraljevini Jugoslaviji. Osim odredbi ustava kojima su garantovana prava jevrejske zajednice i drugih zajednica, kao i zakona koji su bili produktivni za jevrejsku zajednicu, prikazani su i ukazi, uredbe kojima su ograničavana prava Jevreja na našim prostorima, sa posebnim osvrtom na zakonske odredbe, uredbe i naredbe po okupaciji Kraljevine Jugoslavije, kojima su apsolutno kršena građanska prava Jevreja, odnosno ona praktično tim merama nisu ni postojala.

This doctoral thesis analyzes the legal aspects of civil and religious freedoms of members of the Jewish community by examining the constitutional provisions, legislative acts and regulations governing these matters in our region. The subject matter of analysis is the position of the Jewish community in the Principality of Serbia and the Kingdom of Serbia, as well as in the Kingdom of SCS and the Kingdom of Yugoslavia. In addition to the constitutional provisions which guaranteed the rights of the Jewish community and other communities, the paper focuses on the legislative acts which were productive for the Jewish community as well as on the ordinances and decrees which substantially restricted the rights of the Jews in these territories. In particular, there is a specific reference to the legislative provisions, regulations and orders instituted after the occupation of the Kingdom of Yugoslavia. These measures led to an absolute violation of the Jews’ civil rights, which were practically non-existent at the time.
